Acapo congratulates Sport Outlet with victory in imitation case

Acapo has recently had the pleasure of representing Sport Outlet in a law suit where they were accused by TBL Licensing LLC for violation of Sections 25 and 30 of the Norwegian Marketing Act. The core issue was whether 12 shoe styles sold in Sport Outlet stores were illegal imitations of shoes from the brand Timberland.

The Court concluded that none of the styles in question constituted imitations of Timberland’s shoes and that Sport Outlet had not acted in conflict with good business practice. Consequently, there was no breach of either Section 25 or 30 of the Marketing Act. Sport Outlet was also awarded NOK 5 million in compensation for losses incurred as a result of this case and the preliminary injunction that preceded it.

Sport Outlet has grown tremendously since its inception in 2012 and is now an established sports chain with more than 80 stores across Norway. Acapo is proud to assist Sport Outlet with establishing, managing and enforcing their IP rights.
